Please read these Terms of Service ("Terms") carefully before using the SmartWattFlow website or purchasing our digital products. By accessing our website or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using the SmartWattFlow website (https://smartwattflow.com), purchasing our digital products, or using our services, you accept and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and SmartWattFlow.

If you do not agree with any part of these Terms, you must not use our website or services.

2. Description of Service

SmartWattFlow provides digital guides, tutorials, and educational resources for smart-home energy automation. The current catalogue is for Home Assistant. Retired Homey material may remain available to existing buyers, but is not part of current products. Our services include:

  • Digital PDF guides and step-by-step tutorials
  • Configuration files and templates (YAML, scripts, etc.)
  • Email newsletter with energy automation tips and updates
  • Customer support via email
  • Free educational blog content

3. User Eligibility

You must be at least 18 years old to use our services and purchase our products. By using our services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into this agreement
  • You will use our services in compliance with all applicable laws and regulations

4. Digital Products and Purchases

4.1 Product Delivery

All digital products are delivered electronically via email immediately after purchase. You are responsible for:

  • Providing a valid email address
  • Downloading and saving your purchased products
  • Ensuring you have the necessary software to view PDF files

4.2 License and Usage Rights

When you purchase a digital product from SmartWattFlow, you receive a non-exclusive, non-transferable license to use the product for personal use only. You may:

  • Use the guides and configurations for your own smart home implementations
  • Make backup copies for personal use
  • Implement the automations and configurations in your own home

You may NOT:

  • Resell, redistribute, or share our digital products
  • Upload our products to file-sharing or torrent sites
  • Use our products for commercial purposes without permission
  • Remove copyright notices or attributions
  • Claim our content as your own work

4.3 Pricing and Payment

All prices are listed in Euros (EUR) and are subject to change without notice. Payments are processed securely through third-party payment processors (Gumroad). By making a purchase, you agree to:

  • Provide accurate payment information
  • Pay all charges associated with your order
  • Accept that SmartWattFlow does not store your payment card information

4.4 Money-Back Guarantee

We offer a 30-day money-back guarantee on all digital products. To request a refund:

  • Contact us at hello@smartwattflow.com within 30 days of purchase
  • Provide your order number and email address used for purchase
  • Explain briefly what issues you encountered

We approve refund requests within 24-48 hours. Gumroad then returns the money to your original payment method, which typically takes 5-10 business days. We reserve the right to deny refund requests that appear fraudulent or abusive.

4.5 EU/EEA Right of Withdrawal

If you are a consumer in the EU or EEA, you normally have a statutory 14-day right to withdraw from a distance contract without giving a reason. Our products are digital content delivered immediately after purchase. By completing the purchase and starting the download, you consent to that immediate delivery and acknowledge that you thereby lose the statutory withdrawal right (Article 16(m) of Directive 2011/83/EU). Purchases are processed by Gumroad as merchant of record.

The 30-day money-back guarantee in section 4.4 is granted voluntarily, is more generous than the statutory right, and applies regardless.

5. Compatibility Updates

Digital products purchased on or after September 3, 2026 include 24 months of compatibility updates at no additional cost, counted from your date of purchase. When we release updated versions of our guides:

  • You will receive an email notification with download links
  • Updates remain free for 24 months from your date of purchase
  • You are not required to update if you prefer your current version

Products purchased before September 3, 2026 were sold with lifetime updates. That commitment is unchanged and continues to apply to those purchases.

6. Intellectual Property Rights

All content on the SmartWattFlow website and in our digital products, including text, graphics, logos, images, code, and software, is the property of SmartWattFlow and is protected by international copyright laws.

Our trademarks, service marks, and logos may not be used without our prior written consent.

7. User Conduct

You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon or violate our intellectual property rights
  • Upload viruses or malicious code
  • Spam, harass, or abuse other users or SmartWattFlow staff
  • Attempt to gain unauthorized access to our systems

8. Technical Implementation Disclaimer

IMPORTANT: The guides and configurations provided by SmartWattFlow are for educational purposes. While we strive for accuracy:

  • You are responsible for testing all configurations in your environment
  • Smart home automation can affect electrical systems - implement with caution
  • Always follow manufacturer guidelines and local electrical codes
  • We recommend consulting with licensed professionals for critical systems

9. Disclaimer of Warranties

Our digital products and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. SmartWattFlow does not warrant that:

  • Our services will meet your specific requirements
  • The configurations will work perfectly in all environments
  • Our services will be uninterrupted, timely, secure, or error-free
  • The results obtained from using our products will be accurate or reliable

10. Limitation of Liability

To the fullest extent permitted by law, SmartWattFlow shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from your use or inability to use our services
  • Damages resulting from implementation of our guides or configurations
  • Damages to smart home devices or electrical systems

Our total liability shall not exceed the amount you paid for the specific product or service in question.

11. Third-Party Services

Our website and products may contain links to third-party websites or integrate with third-party services (e.g., Gumroad, MailerLite). We are not responsible for:

  • The content or practices of third-party websites
  • The availability of third-party services
  • Third-party terms of service or privacy policies

12. Platform Compatibility

Our current guides are designed for Home Assistant. Each product states its required platform, entities, integrations, and any hardware assumptions. We are not responsible for:

  • Changes made by platform developers that affect functionality
  • Incompatibilities with custom platform modifications
  • Issues arising from outdated platform versions

We will update our guides to reflect major platform changes as part of the compatibility-updates commitment in Section 5.

13. Newsletter and Communications

By subscribing to our newsletter, you consent to receive:

  • Monthly newsletters with energy automation tips
  • Product announcements and updates
  • Occasional promotional offers

You may unsubscribe at any time using the link in our emails.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of this page
  • Material changes will be communicated via email to registered users
  • Your continued use of our services constitutes acceptance of the updated Terms

15. Termination

We reserve the right to terminate or suspend your access to our services at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users or SmartWattFlow
  • Violates applicable laws or regulations

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through:

  • Good faith negotiation between the parties
  • Mediation if negotiation fails
  • Arbitration or litigation in Belgian courts as a last resort

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmartWattFlow regarding the use of our services and supersede all prior agreements.
